
The owner of the bankrupt MtGox exchange, Mark Carpelez, accused the main plaintiff, Gregory Green, of changing the facts on the basis of which a lawsuit was filed to deceive investors.
We would like to remind you that a year ago the Tokyo District Court found Carpelez not guilty on two claims of Gregory Green, but sentenced the defendant to 2.5 years in prison for forgery of documents. Carpelez demanded that the court reconsider the decision and reject Green's claim, which, according to Carpelez, invented many other charges in order to "give more weight" to his current claim.
Carpelez believes that Green can constantly bring different and new theories, accusing MtGox of committing fraud and violation of common law, while not presenting any facts to support these claims. According to Carpelez, Green is trying to do what is prohibited by law - to change the basis of his claim after the invalidity and unfoundedness of their original claims.
Green considers herself deceived by the MtGox exchange, which has claimed the safe custody of funds. The former head of the exchange claims that in this case the claim of Green should be related to the terms of services, but the site MtGox was not published such statements when Green opened an account on the exchange.
Carpeles said that Green was trying to back up his claims with "half-truths" and misleading statements. At the same time, such statements do not prove at all that MtGox has violated the terms of service and do not specify what specific problems faced by Green.
In July, another lawsuit was filed against Mark Carpelez from a Philadelphia user who suffered from the bankruptcy of the exchange. Despite numerous lawsuits, Carpelez announced that he was working on a new project related to the blockage.
